By accessing or using the Geckli platform ("Service") operated by Tropical Agents LLC ("Company", "we", "us"), located at 30 North Gould Street, Sheridan, WY 82801, United States, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

Geckli is an AI-powered platform that enables creators (coaches, consultants, online entrepreneurs) to build personality-adaptive sales experiences, quizzes, and conversation trees for their audiences. The Service includes:

• AI-generated sales funnels and conversation trees based on personality types.
• Interactive quiz creation and management tools.
• Text-to-speech narration and downloadable artifact generation.
• Checkout integration with third-party payment platforms.
• Analytics and optimization features for sales performance.

3. User Accounts

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must be at least 16 years of age to use the Service.
• You are responsible for all activities that occur under your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Creator Responsibilities

If you use Geckli as a creator to build sales experiences, you agree to:

• Only promote products and services that you are legally authorized to sell.
• Provide accurate product descriptions, pricing, and terms to your customers.
• Comply with all applicable consumer protection, advertising, and e-commerce laws.
• Not use the platform to promote illegal, fraudulent, or misleading content.
• Ensure that any third-party checkout links you provide are legitimate and secure.
• Handle customer refund requests in accordance with your stated refund policy and applicable law.

5. Consumer/Visitor Responsibilities

If you interact with a Geckli-powered experience as a visitor or consumer, you agree to:

• Provide truthful information during quizzes and interactions.
• Not attempt to manipulate, reverse-engineer, or exploit the AI systems.
• Understand that purchases are made through third-party creator storefronts, not directly from Geckli.

6. Intellectual Property

• The Geckli platform, its design, features, and underlying technology are the intellectual property of Tropical Agents LLC.
• Content created by creators using Geckli (products, courses, copy) remains the property of the respective creator.
• AI-generated content (conversation trees, quiz logic, artifacts) created through the platform may be used by creators for their business purposes.
• You may not copy, modify, distribute, or create derivative works from the Geckli platform itself without written permission.

7. Data Usage & Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of data as described therein.

• Creators are responsible for informing their end-users about data collection through Geckli-powered experiences.
• Interaction data generated on the platform may be used in aggregated, anonymized form to improve the Service.
• You must not upload or transmit any data that violates third-party privacy rights.

8. API Usage (Google Ads & Third-Party Integrations)

If you use Geckli's integration with third-party APIs (including Google Ads API), you agree to:

• Comply with the respective third-party API terms of service and policies.
• Not use API integrations for unauthorized data collection or scraping.
• Ensure that advertising campaigns created through Geckli comply with the advertising platform's policies.
• Accept that Geckli is not responsible for actions taken by third-party platforms on your account.

9. Prohibited Uses

You may not use the Service to:

• Engage in any illegal activity or promote illegal products/services.
• Harass, abuse, or harm other users.
• Distribute malware, spam, or other harmful content.
• Attempt to gain unauthorized access to the Service or its infrastructure.
• Use automated systems (bots, scrapers) to access the Service without permission.
• Impersonate any person or entity, or falsely represent your affiliation.

10. Limitation of Liability

To the maximum extent permitted by law, Tropical Agents LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes but is not limited to loss of revenue, data, or business opportunities.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Indemnification

You agree to indemnify, defend, and hold harmless Tropical Agents LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising from your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including liability limitations, indemnification, and governing law) shall survive.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Sheridan County, Wyoming.

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
